Terms of Service

1. Introduction

TotalOBD (“we”, “us”, “our”) provides a web-based diagnostics and key-programming application (the “Service”). By accessing or using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Eligibility

You must be legally able to form a contract in your jurisdiction. You are responsible for complying with all applicable laws when using the Service.

3. Accounts & Verification

Accounts are created when you purchase a pass using your email. New emails receive an activation link. You are responsible for the security of your account and devices. We may require password reset and verify your email before access.

4. Passes, Billing & Refunds
  • Passes (e.g., 7/30/90/180/365 days) are sold via Stripe in GBP.
  • Codes are sent by email after successful payment. Access begins on redemption in the app, not purchase date.
  • Trials are limited to one per email. Abuse or circumvention may lead to suspension.
  • Refunds: digital pass sales are generally non-refundable once codes are issued, except as required by law. Contact support if you believe a charge was made in error.
5. License Keys & Redemption

Each code grants time-limited access to features during the pass window. Codes are single-use and non-transferable. We may invalidate codes obtained fraudulently or in violation of these Terms.

6. Hardware & Third-Party Services
  • You need a compatible Vgate vLinker adapter (MC/MC+ or FS). We do not manufacture or warrant third-party hardware.
  • Stripe processes payments; SMTP2GO sends emails. Their terms and privacy notices apply to their services.
7. Acceptable Use
  • Use the Service only for lawful purposes and on vehicles you own or are authorised to work on.
  • No reverse engineering, scraping, unauthorised access, or circumvention of security.
  • No use that may damage a vehicle, violate immobiliser/anti-theft laws, or infringe third-party rights.
8. Vehicle/Immobiliser Disclaimer

Vehicle systems vary by model, year, and condition. The Service provides guidance but does not guarantee success in every scenario. You assume responsibility for any work performed on a vehicle, including ensuring legal authority to program keys and compliance with all applicable laws.

9. Availability & Changes

We may modify, suspend, or discontinue features to improve reliability or security. We will attempt to provide reasonable notice for material changes when practicable.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, loss of data, loss of profits, or vehicle damage arising from use of the Service. Our aggregate liability shall not exceed the amounts you paid for passes in the 12 months preceding the claim.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, violation of these Terms, or infringement of third-party rights.

12. Suspension/Termination

We may suspend or terminate access for suspected fraud, abuse, or violations of these Terms. You may stop using the Service any time.

13. Governing Law & Venue

These Terms are governed by the laws of England and Wales. Courts of England shall have exclusive jurisdiction, except where local law provides otherwise.
